SMITHFIELD, N.C. -

A Johnston County man charged with murdering his 4-year-old girl was in court Friday asking for more privileges at his state hospital.

A judge agreed to give John Violette five hours of supervised time off campus for excursions as long as he's with no more than three patients for each staff member.

His doctor testified for him in court, calling him "a model patient.

His wife also was inside the courtroom.

The judge did deny the request for additional unsupervised time at the hospital for working out.
