Woman charged in NC trooper shooting released to give birth

The pregnant girlfriend of a man accused of shooting a North Carolina State Highway Patrolman has been released into the custody of her parents.

Lyndsey Smith, 21, was arrested and charged with being an accessory after the fact in connection with the February shooting of Trooper Michael Potts. Smith is the pregnant girlfriend of shooting suspect Mikel Brady.

Brady is charged with attempted first degree murder and assaulting a law enforcement officer with a firearm.

A spokesman for the Durham Sheriff's Office said pregnant inmates remain in jail until they need to be taken to the hospital, under armed guard, for delivery. On Tuesday, Smith was released into the custody of her parents so that she can give birth.

If the birth goes smoothly, Smith will be returned to jail after being released from the hospital. If she requires more medical attention that can't be handled in the jail, she is likely sent to Central Prison.

The child goes to the Department of Social Services if the baby is not given to an appropriate family member.

Potts was shot four times during a traffic stop on Highway 70 in Durham on Feb. 18.
