Convicted sex offender found with 4-year-old gets 20-26 year sentence

A convicted sex offender has pleaded guilty to sex offense charges involving a four year old neighborhood child.

In June, Harvell was found near his residence in a wooded area with a young boy and his pants down. A witness told deputies they saw Harvey and the boy engaging in lewd sexual acts.

On Tuesday, a judge sentenced 48-year-old Dallas Harvell Jr. to a minimum of 20 years and maximum of 26 years in the NC Department of Corrections.

On Monday, convicted sex offender, Dallas Harvell Jr., made his first court appearance on his latest sex offense charges.

Carteret County District Attorney Scott Thomas says lawmakers aren't doing enough to keep sexual predator behind bars.

"This is a perfect example of Mr. Harvell should have still been in the North Carolina prison system. He should not have been out here where he's in a position to re-offend against other people," said Thomas.

9 On Your Side looked into why Harvell was allowed out of prison. Thomas said this is the outcome of changes lawmakers made to the way sentences are handed down.

"That's what's going on in the North Carolina of Corrections. Our legislature will not adequately fund our prison system. So instead of making people serve their maximum sentence, they're serving only their minimum sentence," said Thomas.

Thomas said if Harvell had served his maximum sentence, he would not have gotten out of prison until 2014.

Harvell is in the Carteret County Jail under $1.5 million bond. His next court appearance is scheduled for June 14th.

On Saturday, Carteret County Deputies arrested a convicted sex offender for sexual offenses with a four-year-old boy.

In Newport, Dallas Harvell, 48, was found near his residence Friday in a wooded area with his pants down and with the young boy.

A witness reported to deputies seeing Harvey and the boy engaging in lewd sexual acts.

Deputies located the child who was taken to Carteret General Hospital to be examined.

Harvey was booked at the Carteret County Jail.  He is charged with "Indecent Liberties with a Child" and "Attempted First Degree Sex Offense."

Newport residents like Firman Turner say there are a couple of sex offenders who live in the area; however, they are still surprised by this latest incident.

"Makes me sick. I can't believe someone would want to do even something like that, " said Newport resident Firman Turner.

This latest incident comes after Harvell's release from prison in September of 2012.  He was placed on the N. C. Sex Offender Registry after the release.

He has four previous charges that began in 1982 with a conviction of Indecent Liberties with a Child in Carteret County.

Again in 1992, Harvey was charged with Crimes against Nature and Indecent Liberties with a Child in Craven County.

In 2000, the conviction was for Indecent Liberties with a 6-year-old child in Carteret County.

In 2007, Harvey was convicted of a 2004 incident that occurred in Pamlico County for charges of Indecent Liberties with a 7-year-old child.

Newport residents say his previous charges show Harvell should not be allowed near children.

"To do something like that four times, or five times, or how ever many times he did it, he's ..  not there in his mind and he probably needs help," said Newport resident Turner Miller.

"If he's a sex offender he shouldn't even be around. He shouldn't be able to live in this trailer park where there is a bunch of children around," said Turner.

Harvey is currently under a $1.5 million dollar bond. 

He is set to appear in court on Monday.
