Lawsuit against NC AG Cooper gets trial date

RALEIGH, N.C. -

A lawsuit filed more than a decade ago against Attorney General Roy Cooper and his campaign for a television commercial aired during his first winning run for the job may finally go to trial this spring.

A Superior Court judge Friday set a tentative April 28 trial date in the defamation case filed in 2000 by Republican Dan Boyce - who lost to Cooper - and other Raleigh attorneys. The ad accused Boyce and others of charging exorbitant fees in litigation against the state.

Boyce said the ad was untrue because he didn't work on the case the ad addresses. Cooper's lawyers have said Boyce can't prove the ad is false. The case has been delayed by appeals.

Cooper is preparing to run for the Democratic gubernatorial nomination in 2016.
