NC Supreme Court will allow re-trial for Cary's Cooper

RALEIGH, N.C. -

The North Carolina Supreme Court announced Friday that it will not stop Cary's Brad Cooper from getting a new murder trial.

The state Attorney General's Office had appealed the North Carolina Appeals Court ruling that Cooper should get a new murder trial in the death of his wife.

The appeals court granted Cooper a new trial earlier this month in the death of his wife Nancy Cooper. The Supreme Court issued a stay in that decision to review the matter.

Cooper was found guilty in May 2011 of first-degree murder in Nancy Cooper's July 2008 death. Cooper claimed his wife went out for a jog and never returned.

Her body was later found in a ditch.

The N.C. Appeals court granted Cooper a new trial after his attorneys argued that based that a Google Map search could have been done by someone using Cooper's laptop.
