Former New Bern Mayor Lee Bettis wants to be district attorney.
Bettis was in Raleigh Friday morning trying to file paperwork.
Board of Elections officials say he's registered unaffiliated and can't participate in the May primary. So to get on the November ballot he now has to get signatures from 4 percent of voters in Craven, Carteret and Pamlico counties.
Bettis made headlines last summer after police charged him with DWI. He passed the breathalyzer but blood tests found Xanax in his system. Incumbent D.A. Scott Thomas already filed for re-election.
