DADE CITY, FL (WFLA) -

Attorneys for Curtis Reeves were back in a Pasco County courtroom Wednesday for a pre-trial hearing, where they waived Reeves' right to a speedy trial and told a Pasco County judge the case is progressing.

Reeves is the former Tampa Police Captain charged with shooting and killing Chad Oulson in a Wesley Chapel movie theater in January, after the two argued over texting.

Reeves was not present in court on Wednesday. But, after the hearing Reeves' attorney Dino Michaels said his client is doing as well as can be expected.

"For a 71-year-old guy who's never been in trouble before, who's always been a pillar of the community, who's not in the best of health, he's holding up the best he can," said Michaels.

In another new development, the defense agreed to release all discovery evidence in the case. Initially, Reeves' attorneys wanted some of that evidence shielded from the public. But, they changed their strategy.

"Frankly, the more that you're able to see, that things aren't the way they seem to begin with," said Michaels.

The victim's widow, Nichole Oulson, was also in court, flanked by her attorneys. She didn't speak after today's hearing, but one of her attorneys disagreed with Michaels' take on the evidence. "I would say that the video speaks for itself," said attorney T.J. Grimaldi, "In my opinion, the video speaks loudly that this guy had absolutely no reason to do what he did."

Judge Pat Siracusa set another pretrial hearing for 10 a.m. on July 9.
