Melton conspired with five other suspects to kidnap Janssen because Janssen’s daughter is a Wake County assistant district attorney who had previously prosecuted Melton.
Melton is currently serving a life sentence without parole in the Polk Correctional Institution in Butner, N.C.
Authorities said Melton illegally possessed a cell phone in the correctional facility that he used to communicate with Janssen’s wife and the kidnappers. Melton told the kidnappers how to kill and dispose of Janssen’s body using the cell phone, authorities said.
The FBI monitored Melton’s communication on the cell phone during the search for Janssen. Authorities attempted to enter Melton’s prison cell to search for the cell phone, but he barred the door and smashed the phone.
Melton faces a life sentence and a fine of up to $250,000 if he is convicted of the federal conspiracy charge, the Department of Justice said.
The FBI has said prisoners having cell phones has become a big problem. Authorities confiscated 747 prisoner cell phones in North Carolina alone in 2013.
Phones are smuggled in through gifts or reach prisoners when guards are bribed.
