Hope Mills can pursue claim against dam builder

The case of the Hope Mills Lake dam that failed almost four years ago continues in court now that a judge has ruled the town can pursue a negligence claim against one of the builders.

The Fayetteville Observer reported that town attorney T.C. Morphis Jr. says Superior Court Judge Erwin Spainhour made the ruling Wednesday.

Morphis said Spainhour ruled that the town could pursue a negligence claim against AMEC Environment and Infrastructure. The ruling reversed an earlier decision releasing AMEC from negligence claims.

In October 2012, the town sued the designers and builders of the $14 million dam, which failed in June 2010, emptying the town's centerpiece lake. A trial date of July 28 has been set.

The dam was built less than two years before it was breached.
